Terms of Use & End-User License Agreement

Please read these Terms of Use ("Terms") carefully before using BrainFuel ("the App"), operated by BrainFuel (Mohammed Albastaki) ("we," "our," or "us").

By downloading, installing, or using BrainFuel, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms incorporate and supplement the Apple Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict, these Terms govern to the extent permitted by the Standard EULA.

1. Acceptance & Eligibility

By using BrainFuel, you confirm that you are at least 13 years old (or the minimum age of digital consent in your jurisdiction) and are able to form a binding contract. If you use the App on behalf of an organization, you represent that you have authority to bind it to these Terms.

2. Health & Medical Disclaimer

BrainFuel is a wellness and informational tool, not a medical device.

The "Brain Fuel Score," ingredient detection, glucose/energy estimates, and suggestions are automated estimates generated from a photo and may be inaccurate or incomplete.
BrainFuel does not provide medical, nutritional, diagnostic, or treatment advice and is not a substitute for professional judgment.
Do not use BrainFuel to diagnose or treat any health condition. Always consult a qualified health professional before making decisions about your diet, nutrition, or health, especially if you have a medical condition, allergies, or dietary restrictions.
You are solely responsible for any decisions you make based on information from the App.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use BrainFuel on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions.

You may not:

Copy, modify, or create derivative works of the App
Reverse-engineer, decompile, or disassemble the App, except as permitted by law
Rent, lease, lend, sell, redistribute, or sublicense the App
Remove or alter any proprietary notices
Use the App for any unlawful purpose or to develop a competing product

4. Accounts

BrainFuel uses Sign in with Apple. You are responsible for maintaining the security of the Apple ID associated with your account and for activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

Upload content that is unlawful, infringing, or that you do not have the right to submit
Attempt to bypass scan limits, rate limits, authentication, or other technical controls
Probe, scan, or test the vulnerability of our systems, or interfere with their operation
Use automated means to access the App except as expressly permitted
Misuse the App in any way that could harm us, other users, or third parties

6. Subscriptions, Auto-Renewal & Payments

BrainFuel requires an auto-renewable subscription (BrainFuel Pro) to use the App's features. Subscribers get unlimited AI meal scans. BrainFuel Pro is offered as:

Monthly — US$9.99/month, with no free trial; billed at purchase.
Yearly — US$59.99/year, which includes a 3-day free trial for new subscribers.

A discounted yearly offer (US$23.99) may be presented to eligible users as a one-time offer.

Billing. Payment is charged to your Apple ID account at confirmation of purchase. If your plan includes a free trial, you will not be charged until the trial ends, unless you cancel before then.
Auto-renewal. Your subscription automatically renews for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price. For a trial, your account is charged when the 3-day trial ends unless you cancel before then.
Managing & cancelling. You can manage or cancel your subscription (or a free trial) in your Apple ID account settings (Settings → your name → Subscriptions). Deleting the App does not cancel your subscription.
Price changes. Prices may change. Where required, Apple will notify you and seek consent before a renewal at a higher price; otherwise the subscription will not auto-renew at the increased price.
Refunds. All purchases are processed by Apple. We do not process refunds directly. Refund requests must be made to Apple at https://reportaproblem.apple.com.

The specific price, trial (if any), and billing period are presented in the App and on the App Store at the time of purchase.

7. Intellectual Property

BrainFuel, including its design, code, features, content, and branding, is owned by BrainFuel (Mohammed Albastaki) and protected by intellectual property laws. These Terms grant you no ownership rights. Any feedback you provide may be used by us without obligation to you.

8. Third-Party Services

BrainFuel relies on third-party services (including Apple, Supabase, and the Google Gemini API) to function. Your use of those services may be subject to their own terms, and we are not responsible for third-party services. See our Privacy Policy for details on data handling.

9. Termination

We may suspend or terminate your access to BrainFuel at any time for violation of these Terms or conduct we determine is harmful. Upon termination, your license ends and you must stop using the App. You may terminate at any time by deleting the App and, if applicable, requesting account deletion in-app. Provisions that by their nature should survive termination (e.g., disclaimers, limitations of liability, intellectual property) will survive.

10. Disclaimer of Warranties

BRAINFUEL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR ITS ESTIMATES WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BrainFuel (Mohammed Albastaki) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM OR $50 USD.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Governing Law

These Terms are governed by the laws of United Arab Emirates, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in United Arab Emirates, except where applicable law provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, notify you in the App. Continued use after changes are posted constitutes acceptance.
